As Cardmobili – Desenvolvimento de Software, SA (Cardmobili) develops Cardmobili and adopts new technologies to improve the service, it is possible that these Terms of Use may change. Therefore, Cardmobili advises all Users to read these Terms in a regular basis. This document is complemented by our "Privacy Policy", which should also be read regularly.

General Overview

The service.

Cardmobili is a service that allows registered Users to register and manage loyalty cards. The User may register his loyalty cards, independently of belonging to brands associated with the service or not. The User is the sole responsible for all the information he register, and all his activity on the website.

Access.

In order to use the service, the User must create an account, providing a valid email address and a password. The User is the only and exclusive responsible for the maintenance and confidentiality of this password. The User also agrees on not using the access information of any other Cardmobili's User.

Confidentiality.

Cardmobili will not release, pass or sell any personal data of Cardmobili's service, except when the User expressly allows when using the service. All personal data will be kept confidential and safely protected, according to our Privacy Policy.

Acceptance.

By using the service, the User declares to accept the present Terms of Use and Privacy Policy.

Cardmobili's Terms of Use

User Contents.

When using this service, including when sending contents to the website, the User will comply with all current legislation, namely Author's Rights and Connected Rights, Industrial Property Law and Criminal Law. The User will also act in good faith, and use the service in a way that his actions will not offend any third party rights, namely attacking others in regards for their race, nationality, ethnic origin, religion, political belief or gender. The user will not difamate, instate steal, fraud, violence, terrorism, sadism, prostitution, pedophilia, and will not use obscene or pornographic contents.

Commercial usage prohibition.

The User may only use the service's contents for personal usage. It is strictly forbidden to publish, reproduce, broadcast, distribute or make the contents accessible to other parties in any way, namely by making them available in other Website, online service, bulletin board or message board, or paper copies. It is also strictly forbidden to change the contents in any way.

Liability.

It is strictly forbidden for a User to create, introduce, or advise others to create or introduce, any type of virus or malware in this website, which will cause damage or propagate. This website's contents are only meant for informative purposes, therefore, no contents in this website are an advice, or substitute professional advice. The contents in this website do not constitute a contractual relation. Cardmobili will not be held responsible for any damages or losses, direct or indirect, suffered by any User regarding the information in this website. The User is the only and exclusive responsible for any damages, direct or indirect, that he may have caused to himself, Cardmobili or any other party, related with his usage of Cardmobili's service. The User will pay the necessary indemnities, resulting from any action, claim or sentence his actions may originate.

Content authorization.

The User declares he authorizes, at no charge, Cardmobili to display, publish and commercially exploit any contents, texts, data, images or programs he owns and may send to Cardmobili's Website, in an exclusive fashion and for publishing effect in Cardmobili's Website, for as long as Cardmobili's Website will stay online. The User also declares:

1. He has full legitimacy to authorize the usage previously mentioned, got and is the owner of the necessary rights and clearance authorizations, and assured any due payments to other parties that where the legitimate rights' owners contents, texts, data, images or programs the User sent to Cardmobili's Website, to be used in the way mentioned in these Terms;

2. On the right of authorizing the usage of contents, texts, data, images or programs the User may have sent to Cardmobili's Website included in the present Terms of Use, there isn't any claim or judicial process by other parties running on its ownership;

3. There isn't any commitment, nor any condition running from juridical relations between the User and other parties that may forbid or hinder in any way the total or partial execution of these Terms, as defined.

Software.

Any software available to be transferred from this server ("Software") is copyrighted by Cardmobili – Desenvolvimento de Software, SA. The usage of this Software shall be done accordingly to the terms in the end-user license agreement, if available, that is supplied with the Software ("License Agreement"). The end user cannot install any Software supplied, or that includes, a License Agreement, unless he previously agrees with the terms of the mentioned License Agreement.

The Software shall be transferred exclusively for User's usage as defined in the terms of the License Agreement. Any reproduction or redistribution done not accordingly to the License Agreement in strictly forbidden by Law, and will result in heavy civil and criminal sentences. Offenders will be judicially prosecuted.

WITHOUT ANY LIMITATION FOR THE TERMS PREVIOUSLY MENTIONED, ANY SOFTWARE COPIES OR REPRODUTIONS FOR OTHER SERVER OR LOCATION ARE STRICLTY FORBIDEN.

THE SOFTWARE IS ONLY GUARANTIEED ACCORDING TO THE TERMS IN THE LICENSE AGREEMENT. EXCEPT FOR THE WARRANTIES MENTIONED IN THE LICENSE AGREEMENT, CARDMOBILI – DESENVOLVIMENTO DE SOFTWARE, SA. EXCLUDES ALL RESPONSABILITIES ON ALL SOFTWARE WARRANTIES AND CONDITIONS, INCLUDING ALL WARRANTIES AND IMPLICIT COMMERCIALIZATION CONDITIONS, SUITABILITY TO A SPECIFIC END, TITLE AND NO INFRACTION.

Cookies.

The website may use cookies and other tracking mechanisms in order to improve and optimize its usage.

Service terms changes.

Cardmobili reserves its right to change or close the service by any reason and without any previous warning, without incurring in any Liability. Cardmobili reserves its right to modify these Terms of Use without any previous warning and notification. It is of the User's only and exclusive Liability to keep himself informed of any changes.

Warranties.

Cardmobili does not warrant that the services provided by this website will run continuously, or will be error, virus or malware free.

Content Protection and Rights

Property Rights.

All contents on this website, including but not limiting to texts, graphics, images, sounds, software applications and any other information, are owned exclusively by Cardmobili, which has ownership copyright on all contents, excluding the contents supplied by users, advertisers and commercial partners identified as such. The copyright protection of Cardmobili contents extends to all reproduction or copies, obtained from this website contents. These rights cannot be in any way transferred to other parties by the service usage, and the User cannot copy, modify, publish, broadcast, distribute, execute, present or sell any property rights owned by the service or the contents in the website.

Liability.

Cardmobili is not responsible for the accurateness quality, safety, or legality, including copyright law fulfillment, regarding the contents, products, or services in this website, which may have been provided by advertisers or commercial partners, as well as any information contained in other parties websites.

Cardmobili is not responsible for any damage or consequence resulting from the lack of truth of the previously disposed, or from the User's violation of any other party rights or interests legally protected. Cardmobili reserves its right to freely (and without presenting a justification) and anytime remove or not publish any contents, texts, data, images, applications or programs, that it may edit or edited by the Cardmobili's Users, without the User's or any other party having the right to claim any indemnity.
