This Privacy Policy describes how we collect, use and share personal information we obtain from users of the Cardmobili Web Site. This Privacy Policy only applies to the Cardmobili Web Site. Cardmobili reserves the right to revise this Privacy Policy at any time without notice. When this Privacy Policy is revised in a material way, notice will be posted on the Cardmobili Web Site along with the revised Privacy Policy. INFORMATION WE COLLECT
Personal Information that You Provide to Us.
Cardmobili collects “Personal Information” - that is, information such as your full name, email address, mailing address, telephone number, birth date, and information related to your “Loyalty Cards” (as defined in our Terms of Use) - in order to create or enhance our relationship with you and provide you with services. We collect Personal Information that you provide voluntarily to us. For example, Cardmobili collects your email address and a password when you register to use the Cardmobili service and set-up an online Cardmobili account. Cardmobili also collects other Personal Information from you when you provide information on the Profile page. Cardmobili also collects Personal Information regarding your existing Loyalty Cards and to assist you in applying for new Loyalty Cards via the Cardmobili Web Site.
We may also collect Personal Information when you participate in activities on the Cardmobili Web Site such as sweepstakes, contests, surveys, forums, bulletin boards, polls, e-mailing to a friend and subscription registrations; when you submit comments, content or suggestions to us; or when you want us to furnish you with products, services or information.
Personal Information that We Obtain From Partners.
We may obtain Personal Information from selected business partners including entities that direct you to, and/or are featured on, the Cardmobili Web Site (collectively "Partners"). Such Partners may include those businesses who offer Loyalty Cards that are featured on the Cardmobili Web Site.
Personal Information Collected by Third Parties.
Certain transactions and services offered while visiting the Cardmobili Web Site may be processed or provided by third parties under contract with us for fulfillment and other purposes. When your Personal Information is submitted to these third parties for such purposes, we require those third parties to exercise reasonable care to protect your Personal Information and restrict the use of your Personal Information to the purposes for which it was provided.
Non-Personal Information.
"Non-Personal Information" is information about you or your activities through which you cannot be personally identified. When you use the Internet, your web browser or software may transmit certain information to the servers that host the web sites you visit. Such information may include, for example, the unique number assigned to your server or Internet connection, your geographic location, and your interactions with the Cardmobili Web Site, including what pages you look at and what information you download. When you visit the Cardmobili Web Site, our servers collect Non-Personal Information. In situations where it is possible to do so, Non-Personal Information may be linked to Personal Information.

Cookies are small bits of information that the Cardmobili Web Site places on the hard drive of your computer. Cookies remember information about your activities on our site and enable Cardmobili to make your visits to the Cardmobili Web Site more enjoyable. For example, cookies can store your name and password for easy logon to a site you have previously visited and can save information concerning the sections of the Cardmobili Web Site that you visit the most. HOW WE USE THE INFORMATION WE COLLECT
General Principles.
Cardmobili will use and share your Personal Information and Non-Personal Information in a manner that is consistent with this Privacy Policy. Cardmobili will not share your Personal Information with third parties for marketing purposes unless you provide us with express consent to do so as set forth herein. In the event that there is a sale, purchase, reorganization or transfer of the Cardmobili Web Site or a portion of the assets of Cardmobili related to its US operations to a third party (including, but not limited to, an affiliate of Cardmobili), Cardmobili reserves the right to assign and/or transfer all the rights and responsibilities of Cardmobili as set forth herein to such third party.
Uses by Cardmobili.
Subject to this Privacy Policy and applicable law, we may use your Personal Information and Non-Personal Information for our own marketing purposes, including sending you newsletters and notifying you of special promotions, offers and events via postal mail, e-mail, telephone, text message, and other means.
We may also use Personal Information and Non-Personal Information for non-marketing purposes. Some examples of such use include (1) processing and fulfilling requests to add Loyalty Cards to your Cardmobili account; (2) conducting statistical or demographic analysis; (3) customizing your experience at the Cardmobili Web Site; (4) responding to your inquiries or other communications; and (5) reminders related to the Cardmobili Messaging Service (as defined below).
We may combine Personal Information with other generally or publicly available information to help us identify your preferences or interests. Your Personal Information may also be merged with Personal Information available from other sources such as (1) companies that match e-mail addresses with postal addresses; and (2) credit card verification and credit services.
We may use your Personal Information that you provide to set-up an online Cardmobili account and to set-up an internal messaging service that is accessible when you log-in to your Cardmobili account which is accessible via the Cardmobili Web Site (the “Cardmobili Messaging Service”). Through the Cardmobili Messaging Service, we may contact you for our own marketing purposes (or, on behalf of our Partners and Affiliates (as defined below), for our Partners’ and Affiliates’ marketing purposes) including notifying you of special promotions, offers and events. Unless your provide consent in accordance with Sections II.C. or II.D. below, Cardmobili will not share your Personal Information with any Partner or Affiliate on whose behalf Cardmobili may contact you via the Cardmobili Messaging Service.
Sharing within Cardmobili Affiliates.
We may share your Personal Information for marketing purposes with Cardmobili affiliates not covered by this Policy (collectively, "Affiliates") as long as you provide us with express consent to do so. If you subsequently decide that you no longer want your Personal Information to be shared with Affiliates for marketing purposes, you may opt-out of such sharing by notifying us in accordance with Section III.B. below. We may share your Non-Personal Information for marketing purposes with Affiliates regardless of whether you provide us with consent to do so. We may share your Personal Information and Non-Personal Information with Affiliates for non-marketing purposes.
Sharing With Partners for Marketing Purposes.
We may share your Personal Information with our Partners for joint marketing efforts and/or for our Partners' own marketing efforts (via postal service, e-mail, telephone, text message, and other means), or to facilitate your ability to sign-up for a Partner’s Loyalty Card as long as you provide us with express consent to do so. You will have the option to permit us to share your Personal Information with only certain Partners. If you subsequently decide that you no longer want us to share your Personal Information with one or more Partners for marketing purposes, you may opt-out of such sharing by notifying us in accordance with Section III.B. below. We may share your Non-Personal Information for marketing purposes with Partners regardless of whether you provide us with consent to do so.
When we provide Personal Information to our Partners, we require those Partners to exercise reasonable care to protect your Personal Information and restrict the use of your Personal Information to the purposes for which it was provided to them. To determine how Partners use the Personal Information they collect directly from you, or about you, from sources other than us, please consult the privacy policies of our Partners.
Sharing With Partners and Other Third Parties for Non-Marketing Purposes.
We may disclose Personal Information to our Partners and other third parties for non-marketing purposes such as the following:
(1) to validate your Loyalty Card information with a Partner with whom you have a Loyalty Card that you registered in your Cardmobili account;
(2) in connection with a business transaction involving a sale, purchase, reorganization, or transfer to a third party (including, but not limited to, an Affiliate) of any of the assets of Cardmobili and/or the Cardmobili Web Site; and
(3) to comply with a court order, subpoena, search warrant, applicable legal requirements or other valid legal process.
When we provide Personal Information to our Partners and other third parties for such purposes, we require those Partners and third parties to exercise reasonable care to protect your Personal Information and restrict the use of your Personal Information to the purposes for which it was provided to them.
YOUR COMMUNICATION PREFERENCES
Establishing an Account and Profile.
We are committed to protecting the accuracy and confidentiality of your Personal Information and encourage you to tell us how you want us to communicate with you and let you know about special offers. By creating a Cardmobili online account and profile, you can view and update your Personal Information and choose your communication preferences. Pursuant to this Privacy Policy, your account gives you the ability to choose which entities – Affiliates, and/or Partners – that you would like to receive marketing-related communications from and how. You can select from communications preference options including direct mail, e-mail, telemarketing, and text messaging.
How to Opt-Out.
If you wish to opt-out of receiving solicitations from us or do not want us to share your Personal Information with Partners or Affiliates for marketing purposes, you can record your preferences by modifying your Cardmobili online profile. Within approximately forty-eight (48) hours of receipt of your opt-out request, Cardmobili will use reasonable efforts to implement such opt-out request.
SECURITY
Personal Information and Non-Personal Information collected by Cardmobili and the Cardmobili Web Site are stored on secure servers. For users’ protection, the password to access a user’s account is stored encrypted in our servers, and it is not accessible to anyone including employees of Cardmobili. Therefore, if a password is lost or forgotten, the user must create a new password to access the service. The secure servers are protected by firewalls and other industry standard security measures. However, no security system is impenetrable, and these systems could become accessible in the event of a security breach.
You are responsible for ensuring that the computers, electronic devices and electronic communication methods you use will provide adequate security for communicating with us. We are not responsible for the disclosure or interception of your information before we receive it.
OTHER WEB SITES
We are not responsible for the information collection or privacy practices of other web sites, including web sites operated by our Partners. You should review and understand the privacy policies posted on any linked sites (or any other site) you visit before providing any Personal Information.
MISCELLANEOUS
The Cardmobili Web Site is maintained on servers located outside of the United States, and Personal Information and Non-Personal Information are stored on computers and servers located outside of the United States. We make no representation that the practices described in this Privacy Policy are compliant with laws outside of the United States that apply to the collection, security, use and disclosure of Personal Information.
